Terms of submission
As conditions of entry into this contest, and by providing a submission, each entrant:
• Grants permission for winning videos and winners' names and recipes to be owned, used and posted for the purpose of Westside Pulse
• Warrants and represents that her/his submission(s): (a) are original to the entrant and have been legally obtained and created, (b) do not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, regulations, or network standards; (c) have not been entered in or won previous contests or awards; and (d) have not been published previously in any medium. All submissions become property of Westside Pulse.
• Irrevocably grants to Westside Pulse, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse the entrant's name, address, image, voice, likeness, statements, biographical material and submission, including, but not limited to, the video, audio file or digital recording and performances contained in any of the above items, as well as any additional photographic images, video images, portraits, interviews or other materials relating to the entrant and arising out of her/his participation in this contest (with or without using the entrant's name) (collectively, the "additional materials") in any media, without limitation, and without additional review, compensation, or approval from the Entrant or any other party.
• Forever waives any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude Westside Pulse’s use of the entrant's submission, or require the entrant's permission for Westside Pulse to use them for any purpose, and agrees to never sue or assert any claim against Westside Pulse’s use of materials; and
• Agrees to indemnify and hold Westside Pulse and its respective affiliates, officers, directors, agents, and any employees, harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the indemnitees due to or arising out of the entrant's entry materials or additional materials, or the entrant's conduct during and in connection with this contest.
SUBMISSION REQUIREMENTS:
Videos must be no longer than three minutes in length. Longer submissions will automatically be disqualified. Do not include music that you have do not have the legal rights to use. Most music is copyrighted.
All entrants must be 18 years or older at time of submission.
Submissions that are not uploaded in accordance with these instructions may be disqualified.
Once an entrant sends in a video and the accompanying documents, the submission is final and may not be modified or edited further. Westside Pulse may, in its sole discretion, remove, delete and/or disqualify submissions deemed to be inappropriate or otherwise non-compliant.
All submissions will be reviewed for content before being published or judged; however, such review does not relieve entrant from responsibility for compliance with the Terms of Use and these Official Rules. Submissions that do not comply with the Terms of Use or these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the sponsor, in its sole discretion, will be disqualified and will not be considered for a prize. Westside Pulse makes the final determination as to which submissions are eligible to take part in this contest and be considered for a prize.
SELECTION OF WINNER:
Up to three winning videos will be selected by a judging process that will evaluate each eligible submission based on judging criteria. All winners are subject to verification, including without limitation, verification of eligibility and compliance with these official rules. If a winner cannot be verified, or if a winner is otherwise unable to accept their prize, prize will be forfeited and may be awarded to an alternate winner
PRIZES:
Prizes will be awarded as follows:
Round One Prizes: 10 free smoothies or coffee, not both, to each round one winner from January 2 - January 5.
Final Round Prize: Party 6-9PM any weekday in January; no outside food or beverages allowed. Smoothies, coffee and Boba are unlimited. All other items will be available at regular menu charge.
All prizes above are non-transferable and no substitution by winner or cash equivalent is permitted. Awards will be fulfilled by Feb 1, 2013.
Participation constitutes entrant's full and unconditional agreement to and acceptance of these official rules. By participating in the contest, entrant is representing and warranting that he/she has read and understood, and agrees to be bound by, these rules. Including the guides and rules referred to herein, these official rules constitute the entire agreement between the entrant and Parallels in relation to the contest. They govern the entrant's participation and supersede any prior agreements between entrant and Parallels and relating to the contest.
Westside Pulse reserves the right to promote and publicize, through any means available to us, the progress, development, process, news, and success of all entries, in whole or in part, to promote Westside Pulse video contest and future video contests. In addition, Westside Pulse shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submissions for any purpose which they deem necessary or desirable, without the need for any further compensation by them, and each Entrant irrevocably waives any and all so-called moral rights they may have in the Submission submitted by him or her.
